If you are considering filing a case in the Federal District Court for the Northern District of California, San Jose Division or have filed and are representing yourself, we may be able to help you.

The Federal Legal Assistance Self-Help (“FLASH”) center is offering legal services to individuals who are representing themselves, or are considering representing themselves, in the San Jose federal district court.  If you are contemplating filing or are already involved in a federal lawsuit, either as a plaintiff or as a defendant, legal assistance is now available.  The Self-Help center provides the opportunity for consultation with an attorney on a variety of legal matters, including:

  • Obtaining legal advice regarding the merits of a potential federal lawsuit;
  • Obtaining legal advice on important procedural aspects of filing a lawsuit in federal court, including addressing whether you are filing in the correct court;
  • Obtaining assistance with preparing and filing litigation forms, including filing a complaint, answer, requests for discovery, response to requests for discovery, motions to dismiss and motions for summary judgment;
  • Obtaining legal advice on strategic decisions related to litigation;
  • Obtaining advice on how to plan and prepare for case management conferences, settlement conferences, negotiations, and other case-related court hearings;
  • Assisting with interpreting and understanding opposing party filings and court orders.

A high percentage (perhaps as many as 30%) of the pro se litigants who file cases in the district court do so based on inadequate or incorrect information as to venue or jurisdiction. Pro se plaintiffs also file incorrect pleadings in the court ...
